With the astounding increase in social networking internet activity over the past several years, today's employers are faced with a quandary: how can you ensure the utmost protection of your company's reputation and confidential business information, while still protecting your employees' privacy and free speech rights? In this seminar, NCHC partner Karen Gabler will speak about workplace guidelines for employees' use of social media, including blogs, forums and social networking sites such as MySpace, Facebook, Twitter, LinkedIn, YouTube and Word Press, among others. Topics covered will include:

  • Creation of effective social media policies for 2010
  • Use of company equipment for social media activities
  • Guidelines for published internet content
  • Protection of confidential and trade secret company information
  • Defamation and harassment arising from internet postings
  • Conflicts of interest between employees' work activities and their personal lives
  • Employee privacy
  • Employee rights to free speech
  • Employees' lawful off-duty conduct

Companies may also risk liability when their employees publish internet comments designed to promote a company product or service on their own social media page, with or without the company's prior approval. Newly-released guidelines regulate the content of any review, advertisement or endorsement published by company employees. NCHC partner Melissa Sayer will speak about the new FTC Guides Concerning the Use of Endorsements and Testimonials in Advertising. Topics covered will include:

  • Mandatory disclosure of material connections between an endorser and an advertiser
  • Required procedures to advise employee-endorsers of disclosure requirements
  • Training for compliance purposes
  • Monitoring employee conduct without violating employee privacy
